Service members Civil Relief Act
If you have been called to active duty, you may be eligible for a lower interest rate on debts incurred before your active duty status.
Under the Soldier's and Sailor's Civil Relief Act, as soon as an individual goes on active duty (or receives orders to report for active duty), that person may begin paying 6 percent interest on obligations incurred prior to active duty. Outstanding balances on lines of credit taken out prior to active duty, including credit card lending, home equity lines of credit, home mortgages, car loans, share secured loans, and signature loans, will be subject to a 6 percent interest rate limit during active duty.
The Act does not relieve active duty service members of obligations to repay debts. The 6 percent interest rate limit does not apply to new advances under an existing credit card or home equity line of credit program. In addition, the rate limitation does not apply to loans granted under the Guaranteed Student Loan Program. However, the Department of Education has in the past deferred or suspended payments on student loans for service members called to active duty.
If you've been called to active duty, please contact us.
